ONLINE WINE SHOP: TERMS AND CONDITIONS
These are our terms and conditions for any
orders placed at Cape Town Wine Route.
Please read these purchasing terms and
conditions carefully as they affect your rights and liabilities under the
law and set out the terms under which Cape Town Wine Route makes these products available
to you. If you do not accept these terms and conditions you may not
purchase any products from Cape Town Wine Route. Any purchase from you on this website,
indicates your express agreement to be bound by these terms and
conditions.
PRICING
All prices
are inclusive of VAT. VAT is deducted in the checkout stage for all export
orders. The price of the items excludes the delivery charge which will be
calculated during checkout. View our shipping rates here

AVAILABILITY
We will try
our utmost to ensure availability, but there are times when certain wines
may be out of stock. In that case, Cape Town Wine Route's team will
contact you and suggest alternatives at the same pricing. If you decide
against the alternatives, we will ship available items less the out of
stock items or cancel the order if you prefer to do so. Your credit card
will not be charged until we ship your order, and you will not be charged
for out-of-stock items.
ACCEPTANCE
We will acknowledge your order
via email. Our acceptance of an order takes place on dispatch of the
order, at which point the purchase contract will be made and you will be
charged.
We cannot sell wine to anyone under the age of
18. For this reason, we may refuse an order at our discretion and orders
may not be transferred from the customer to any other person. If the
shipment is destined for the United States, you must be 21 years of age to
place an order for wine.
DELIVERY
Subject to availability and
receipt of payment, delivery will be made to the address specified by you
during checkout (shipping details).
We do our best to secure delivery within 4
days of the date of your order but will not be liable for loss occasioned
by delay in delivery arising out of any cause beyond our control. Sea
freight shipments will take approximately 6 weeks to arrive at the nearest
port.
All goods must be signed for on delivery by an
adult aged 18 years or over. If no one of that age is at the address when
the delivery is attempted the goods will be retained by the courier, in
which case notification of the attempted delivery will be given. The
courier service will subsequently arrange a suitable time for delivery,
will return later or on the following working day.
Delivery to international destinations exclude
duties and taxes which may be payable. It is your responsibility to
determine (prior to order placement) and make payment for these additional
charges when contacted by the delivery courier.
CANCELLATION
You have the right
to cancel your order up to 14 working days after the day following the delivery
of the goods by calling Cape Town Wine Route on +27 (0)73 613 2561. You can also cancel your
order by fax or e-mail. In the event that the goods have already been
dispatched at the date of receipt of your cancellation of the order you
must return the goods to us and we will refund you with the price of the
goods within 30 days, beginning with the day on which notice of
cancellation was given.
We will process a charge in respect of the
shipment of the goods. If you do not return the goods or fail to make them
available for collection within 30 days of your order, you will be deemed
to have accepted the goods and will be charged for your
order.
RETURNS
Cape Town Wine Route guarantees the quality of
all our products and your satisfaction is our foremost priority. If for
any reason you are dissatisfied with your order, please contact us within
14 days of receipt of your order. View our Return

Cancelled and/or returned orders are subject to the
dispatch and return shipment charges. These charges must be paid by you. However,
if the wine is found to be faulty in any respect, make sure to return
the balance of the wine inside the bottles.
CREDIT CARD
REFUNDS
Cape Town
Wine Route processes refunds to the credit card used at the time of
purchase upon receiving your returned shipment. Please allow 30 days for
the refund to appear on your credit card statement. If you have made
payment by any other means we will send you a cheque or will transfer the
refund via EFT.
PAYMENT
Payment may
be made via Visa, Master
Card, Diners or American Express credit cards (optional) or by bank transfer (international
bank transfer, EFT) into the Cape Town Wine Route's bank account, the details
of which will be provided during checkout.
CREDIT CARD ACQUIRING AND
SECURITY
Credit
card transactions will be acquired for Cape Town Wine Route by MyGate (Pty) Ltd who are
the approved payment gateway for Standard Bank of South Africa. MyGate
use SSL3 and no credit card details are stored on Cape Town Wine Route's website. Users
may go to www.mygate.co.za
to view their security certificate and security policy. All encryption
complies with international standards. Encryption is used to protect the
transmission of personal information when completing online transactions.
MyGate's Internet servers are protected by firewalls and intrusion
detection systems.
CUSTOMER DETAILS SEPARATE FROM CARD
DETAILS
Customer details will be stored by Cape Town Wine Route separately from card details which are entered by the client on MyGate's secure site. For more detail on MyGate, refer to www.mygate.co.za. MERCHANT OUTLET COUNTRY AND
TRANSACTION CURRENCY
The merchant
outlet country at the time of presenting payment options to the cardholder
is South Africa. Transaction Currency is ZAR (South African Rand).
RESPONSIBILITY
Cape Town Wine Route takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods. Our liability to you in connection with any
order will not exceed the total price charged for the relevant items and
the shipping costs.
YOUR PRIVACY
Cape Town Wine Route has taken all reasonable steps to protect the personal information of its clients. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). COUNTRY OF
DOMICILE
These terms and conditions shall be governed by and construed in accordance with the laws of South Africa. Any disputes will be decided only by South African courts. If any of the abovementioned terms or
conditions are held by a court of competent authority to be unlawful,
invalid or unenforceable, in whole or in part, this will not affect the
validity of the remaining terms and conditions which will continue to be
valid and enforceable to the fullest extent permitted by law.
VARIATION
Cape Town Wine Route may, in its sole discretion, change this agreement or any part thereof at any time without notice. ACT OF GOD (1) In case Cape Town Wine Route is unable to fulfill her contractual commitment because of an Act of God (in particular war, natural disasters), eWine GmbH is exempted from her contractual commitments for the duration of the given situation. (2) In case Cape Town Wine Route is unable, for a period longer than one month, to execute the client’s order respectively to deliver the merchandise because of an Act of God, the client is entitled to revoke the agreement. DATA PROTECTION Cape Town Wine Route will obey all legal requirements regarding data protection, in particular the conditions of the data protection act for telecommunication. FINAL CONDITIONS (1) The language of the agreement is English. (2) Should one regulation of the conditions of the agreement be or become null and void, all the other ones will remain effective. Cape Town Wine Route and the client together will replace the void regulation by an effective one which will best suit the economic interest of both parties. |
